Please read these Terms of Service carefully before using our website or engaging our services. By accessing our website or requesting a quote, you agree to be bound by these terms.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Orozco's Commercial Equipment and Handling, LLC, doing business as Orozco's Racks ("Company," "we," "us," or "our"), governing your access to and use of the website at www.orozcosracks.com (the "Site") and any services we provide.
By accessing or using the Site, submitting a contact or quote form, or engaging us to provide products or services, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site and may not engage our services.
These Terms apply to all visitors, customers, and other users of the Site. If you are using the Site on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
Orozco's Racks provides industrial rack system products and related services to business customers, including but not limited to:
The information on our Site is intended to describe our products and services and to allow business customers to request quotes. The Site does not constitute a binding offer to sell any product or service at any particular price. All sales are subject to a separately executed written quote or purchase agreement.
All quotes provided by Orozco's Racks are valid for thirty (30) days from the date of issuance unless otherwise stated in writing. Prices are subject to change after the quote expiration date.
A purchase order or written acceptance of a quote, together with any required deposit, constitutes a binding order. Standard payment terms are net 30 days from invoice date unless otherwise agreed in writing. Orozco's Racks reserves the right to require deposits or prepayment for large orders, custom orders, or customers without an established credit history.
Late payments are subject to a finance charge of 1.5% per month (18% annually) or the maximum rate permitted by applicable Texas law, whichever is less, accruing from the due date. In the event of collection proceedings, the customer agrees to pay all reasonable costs of collection, including attorney's fees.
We make reasonable efforts to ensure that product specifications, load ratings, and descriptions on our Site are accurate. However, product specifications are subject to change without notice due to manufacturer updates. Final specifications for any order will be confirmed in writing at the time of quote.
Product availability is subject to manufacturer lead times and inventory. We will notify you promptly if any ordered product is subject to an extended lead time or becomes unavailable.
Installation services are performed in accordance with OSHA regulations and Rack Manufacturers Institute (RMI) standards applicable at the time of installation. The customer is responsible for:
Any modifications to an installed rack system after our installation — including reconfiguration, addition of components, or changes to load weights — must be reviewed by a qualified engineer and may void our installation warranty. Orozco's Racks is not responsible for damage resulting from customer modifications or from loading the rack system beyond its rated capacity.
Delivery timelines are estimates and not guaranteed. Orozco's Racks is not responsible for delays caused by carriers, customs, weather, force majeure events, or factors outside our reasonable control. Risk of loss transfers to the customer upon delivery to the customer's designated receiving location.
The customer is responsible for inspecting all delivered materials for visible damage or shortage at the time of delivery. Any claims for visible damage or shortage must be noted on the delivery receipt and reported to Orozco's Racks within 48 hours of delivery. Concealed damage must be reported within 5 business days of delivery.
Rack products supplied by Orozco's Racks carry the manufacturer's warranty as provided by the respective manufacturer. Orozco's Racks does not provide an independent product warranty beyond that offered by the manufacturer.
Installation workmanship is warranted against defects in installation for a period of one (1) year from the date of installation completion. This warranty covers defects in the installation work itself — including improper anchoring, incorrect assembly, and failure to follow manufacturer specifications — and does not cover damage resulting from forklift impact, overloading, customer modification, or normal wear and tear.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, OROZCO'S RACKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OROZCO'S RACKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF BUSINESS, OR PROPERTY DAMAGE NOT DIRECTLY CAUSED BY OUR NEGLIGENCE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or relating to these Terms, our website, or our services shall not exceed the total amount paid by you to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Orozco's Commercial Equipment and Handling, LLC and its officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of our Site or services in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your negligence or willful misconduct; or (d) any misrepresentation made by you in connection with an order or service engagement.
All content on our Site — including text, photographs, graphics, logos, icons, and software — is the property of Orozco's Commercial Equipment and Handling, LLC or its content licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any Site content without our prior written permission.
Product images from Interlake Mecalux are used with authorization as an authorized dealer partner and remain the property of Interlake Mecalux.

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE THE SITE AT ANY TIME WITHOUT NOTICE.
These Terms and any dispute arising out of or related to these Terms, the Site, or our services shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Webb County, Texas, and you hereby consent to personal jurisdiction and venue in those courts.
Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute informally by contacting us at the information provided in Section 15. We will attempt to resolve the dispute within 30 days of receiving written notice.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
Changes to these Terms do not affect the terms of any written purchase agreement or service contract already in effect between you and Orozco's Racks at the time of the change.
